SALES TAX. All sales are subject to State Sales Tax Laws. Sales Tax: 7.75% applies to all purchases. For DMV sales, the current tax rate in the county in which the buyer resides will apply. If purchasing for resale, valid CALIFORNIA resale certificate must be shown and resale card must be completed and signed PRIOR TO INVOICING. Out of state buyers will pay sales tax and will be reimbursed upon presentation of signed bill of lading from common carrier showing merchandise was taken out of state.
BUYERS PREMIUM. 15% Buyers Premium - will be added to your bid price. On Bankruptcy Assets only a 10% Buyers Premium will be applied.
NO WARRANTY: All items are sold AS IS WHERE IS, without guarantee of any kind. The descriptions of items are believed to be correct. Nevertheless, neither those descriptions nor any oral statements made by the Owner (or his agents or officers) or the Auctioneers (or his agents or officers) concerning any item shall be construed as a warranty, either expressed or implied, as to the authenticity of, or defect in any lot, and will not be held responsible for advertising discrepancies or inaccuracies. It is the buyer's responsibility to confirm item quantities before bidding; no adjustment nor credits will be made on shortages when items are sold as lots with estimated counts. Bidder agrees to indemnify and hold TMC Auction, Ltd. harmless from and against any and all claims, damages, liabilities and expenses including reasonable attorney's fees relating to the breach or dispute of this agreement.

An $85 document processing fee, a $65 smog fee (if applicable) and a $30 DMV electronic filing fee will be charged by the auction company for every DMV purchase, California law does not provide for a "cooling off" or other cancellation period for vehicles. Therefore you cannot later cancel a contract simply because you change your mind, decide the vehicle costs too much, or wish you had acquired another vehicle. TMC Auction offers a 2-day cancellation option that applies only to passenger vehicles purchased for personal or household use. This cancellation option does not apply to motorcycles, off-road vehicles, recreational vehicles, or vehicles sold for business or commercial use, or any vehicle priced at or above $40,000. In order to exercise this option you must inform TMC Auction at the time of purchase on that specific auction day. The amount is non-refundable and the purchaser will also be charged a restocking fee. The vehicle must be returned by 3:00pm not more than 2 days following the date of the purchase contract. The vehicle must also be in the same condition and the mileage must not exceed the permitted (250) miles otherwise the option is void. Additional fees for purchasing this cancellation option will apply.
