1. Sale Format
This is a live, on-site auction. The great majority of items sell exclusively at the live event, in person, with no online bidding option. A select group of lots, chosen and cataloged in advance, will also be open to online simulcast bidding through bidburgess.com, running concurrently with the live sale.

2. Date, Time & Location
- Preview/Inspection: Friday, July 31, 2026, 10:00 AM–3:00 PM
- Auction Date & Time: Saturday, August 1, 2026, 10:00 AM

Buyers are strongly encouraged to attend the preview or review online photos/descriptions in advance. All items sell as-is, where-is (see Section 6).
3. Registration & Bidder Numbers
- All on-site bidders must register in person and present a valid, government-issued photo ID to receive a bidder number.
- Online/simulcast bidders must register through bidburgess.com and may be required to place a verified credit card on file prior to bidding.
- Burgess Auctions reserves the right to refuse registration or bidding privileges to any individual.
4. Buyer's Premium & Payment
- A 15% buyer's premium will be added to the final hammer price of every lot, whether purchased live or via simulcast.
- Applicable Indiana sales tax will be added unless a valid tax-exempt certificate is presented at checkout.
- On-site buyers: cash, check, and major credit cards accepted.
- Simulcast buyers: payment is processed per bidburgess.com/Marknet platform terms, typically via the card on file.
- Payment is due in full on the day of the auction (on-site lots) or per the online platform's settlement schedule (simulcast lots).
5. Removal of Purchases
- All items are the buyer's responsibility to load and remove.
- Buyers should bring appropriate help, tools, and equipment for loading heavier items (tractors, trailers, mowers, etc.).
- Removal times will be announced day-of; items not removed by the posted deadline may be subject to a storage fee or forfeiture, at Burgess Auctions' discretion.
- Burgess Auctions and its staff are not responsible for loading labor or equipment damage occurring during buyer-arranged removal.
6. As-Is, Where-Is / No Warranty
All items sell as-is, where-is, with all faults, and without any warranty or guarantee of any kind, express or implied, including condition, merchantability, or fitness for a particular purpose. Descriptions and photographs are provided as a courtesy and believed accurate but are not guaranteed. Buyers are responsible for their own inspection prior to bidding.
7. Bidding & Sale Conduct
- All items sell to the highest bidder, live or simulcast, at the auctioneer's discretion.
- The auctioneer reserves the right to withdraw, combine, split, or re-offer any lot, and to resolve any bidding dispute.
- In the event of a discrepancy between a floor bid and a simulcast bid, the auctioneer's ruling is final.
- No buy-back or reserve applies except where specifically announced.
8. Liability
Persons attending the preview or auction do so at their own risk. Burgess Auctions, its staff, and the property owners are not responsible for accidents, injury, or loss occurring on the premises.
9. Agreement
Registering to bid, either in person or via bidburgess.com, constitutes acceptance of these terms and conditions in full.
