AUCTION TERMS AND CONDITIONS
311 East Staat Street, Fortville, IN 46040 | Public Real Estate Auction
Saturday, December 5, 2026 | 10:00 AM Eastern | Live on-site with online bidding
By registering to bid, every bidder agrees to these terms. Please read them carefully before the auction.
1. SELLER AND AUCTIONEER
The seller is R. Herrera LLC. The property is marketed by Burgess Auctions LLC (AC32600034; Zack Burgess, AU19600029) in cooperation with J. Snider Real Estate (RB14045952). Both represent the seller.
2. AUCTION METHOD
The property is offered as a seller confirmation auction. Bidding opens at $80,000 and only advances from there. The seller will accept or reject the high bid within 24 hours of the close of the auction. The auctioneer controls the bidding increments and the conduct of the auction and has final say on any bidding dispute.
3. BUYER'S PREMIUM
A 10% buyer's premium is added to the high bid. The high bid plus the buyer's premium is the total purchase price written into the purchase agreement. Example: a high bid of $90,000 plus a 10% buyer's premium of $9,000 equals a total purchase price of $99,000.
4. EARNEST MONEY
The successful bidder deposits $5,000 in earnest money by wire transfer to Fidelity National Title by 5:00 PM on Monday, December 7, 2026. Wire instructions are provided only by Fidelity National Title, directly to the successful bidder. Always confirm wire instructions by phone with Fidelity before sending funds. The deposit is applied to the purchase price at closing and is non-refundable if the buyer fails to close, except as stated in the purchase agreement.
5. PURCHASE AGREEMENT
The successful bidder signs the Agreement to Purchase Real Estate at Auction immediately after the auction, without changes. Online bidders sign it electronically on auction day. Review the purchase agreement before you bid.
6. NO CONTINGENCIES
The sale is not contingent on financing, inspection, appraisal, or the sale of other property. If you plan to finance, have your lender approval in place before you bid. Denial of financing or a low appraisal does not excuse the buyer from closing.
7. INSPECTIONS AND CONDITION
The property sells as-is, where-is, with all faults, and with no warranties expressed or implied. The property is vacant. Bidders are responsible for their own inspections, which must be completed before the auction during open houses or by appointment with Jason Snider. The seller has never occupied the property and makes no representations as to its condition on the Seller's Residential Real Estate Sales Disclosure form. The house was built in 1950, so a lead-based paint disclosure and pamphlet are provided, and the buyer waives the 10-day lead-based paint inspection period. Any personal property remaining at closing conveys with the property, as-is.
8. TITLE AND DEED
The seller conveys marketable and insurable title by General Warranty Deed, free of liens, subject to easements, covenants, and restrictions of record. The seller pays for an owner's title insurance policy in the amount of the purchase price.
9. CLOSING
Closing takes place at Fidelity National Title on or before Monday, January 4, 2027. The buyer pays all closing costs customary to buyers in Hancock County, including any lender fees. The seller pays costs customary to sellers.
10. TAXES
Seller pays the real estate tax installment due November 10, 2026. Buyer is responsible for any and all real estate taxes due and payable after that, with no proration. Semi-annual taxes are currently $917 (2025 tax year).
11. POSSESSION
Possession transfers at closing, upon delivery of the deed.
12. BIDDER REGISTRATION
All bidders must register and show a valid photo ID. Online bidders register at bidburgess.com and must be approved before the auction. Bidders acting for another person or entity must provide written authority to bid.
13. ONLINE BIDDING
Online bidding is offered as a convenience. Burgess Auctions is not responsible for internet outages, software errors, or bids that fail to register. Online and on-site bids carry the same obligations.
14. BROKER PARTICIPATION
A 3% commission, based on the high bid and paid at closing, is available to a licensed buyer's broker who completes the Broker Participation Agreement by 5:00 PM on Friday, December 4, 2026. No commission is paid to a broker who does not register on time.
15. BUYER DEFAULT
If the buyer fails to deposit earnest money or to close as agreed, the buyer forfeits the earnest money, and the seller may pursue all other remedies available under Indiana law.
16. AGENCY DISCLOSURE
Burgess Auctions LLC and J. Snider Real Estate act solely as agents of the seller.
17. AUCTION-DAY ANNOUNCEMENTS
Announcements made on auction day take precedence over all printed, advertised, and online materials.
18. GOVERNING LAW
These terms are governed by Indiana law, with venue in Hancock County, Indiana.
