Real Estate & Personal Property Auction • 6080 Gifford Street, Indianapolis, IN 46228 • Friday, October 30, 2026 • Real Estate at 12:00 Noon
Order of sale: Selling begins at 10:00 AM with the contents of the home. The real estate will be offered at 12:00 noon, followed by selected lots sold live on site and online.
By registering to bid, on site or online, each bidder agrees to these Terms & Conditions. Announcements made on auction day take precedence over printed or online material.
Part A — Real Estate
1. Property. 6080 Gifford Street, Indianapolis, Marion County, Indiana 46228; legally described as Giffords Fox Hill Drive Add L8 & L21; parcel 490603112033000800 (the "Property").
2. Seller. The Property is offered by Devorn Blueitt, the owner of the Property ("Seller").
3. Auction method. Seller Confirmation Auction. The final high bid is subject to Seller's acceptance or rejection immediately following the close of bidding. Opening bid $90,000. The auctioneer controls the bidding increments and may refuse any bid.
4. Buyer's premium. A 10% buyer's premium is added to the high bid to determine the total purchase price, regardless of bidding method.
5. Agreement to Purchase. The successful bidder signs the Agreement to Purchase Real Estate at Auction immediately after Seller's acceptance. Online winners sign electronically the same day. The Agreement is not assignable without Seller's written consent.
6. Earnest money. $5,000, non-refundable except as stated in the Agreement, wired to Fidelity National Title by 5:00 PM Eastern on Monday, November 2, 2026. Buyer must confirm wiring instructions by telephone directly with Fidelity before sending funds. Failure to deliver earnest money on time is a default; time is of the essence.
7. Closing. Closing occurs within 30 days of the auction at Fidelity National Title. The balance of the purchase price is due at closing by wire or certified funds. Buyer pays its own lender costs, if any; the sale is not contingent on financing.
8. Title and deed. Seller furnishes an owner's policy of title insurance in the amount of the purchase price and conveys by Warranty Deed, subject to easements, covenants, restrictions and matters of record. If Seller cannot deliver insurable title, Buyer's sole remedy is return of the earnest money.
9. Closing costs. Customary closing costs are divided as provided in the Agreement to Purchase. Each party pays its own attorney fees.
10. Real estate taxes. Seller pays the real estate taxes due in November 2026. Buyer assumes all real estate taxes due and payable thereafter, with no proration or credit to Buyer at closing. There is no homestead deduction on file for the Property.
11. Condition. The Property sells AS-IS, WHERE-IS, WITH ALL FAULTS, with no warranty of any kind, express or implied. There are no financing, appraisal or inspection contingencies, and Buyer waives the 10-day inspection period. Bidders are responsible for their own inspections before the auction. Square footage, lot size, room dimensions, school assignments and other figures come from public records and the MLS and are not guaranteed.
12. Lead-based paint. The home was built in 1958. Seller has no reports or records regarding lead-based paint. Buyer acknowledges receipt of the lead-based paint disclosure and pamphlet and waives the 10-day risk assessment or inspection opportunity.
13. Possession. Possession is delivered at closing upon recording of the deed and disbursement of funds.
14. Personal property in the house. Personal property remaining in the house or garage at closing conveys with the real estate, with no warranty and no adjustment to price.
15. Broker participation. A 3% commission on the high bid (excluding the buyer's premium) is paid at closing to a licensed broker who registers the buyer by 5:00 PM Eastern on Thursday, October 29, 2026 using the Broker Participation Agreement. No commission is paid to a broker acting as a principal or bidding for a related party.
16. Agency. Burgess Auctions LLC and J. Snider Real Estate represent Seller only.
Part B — Personal Property
1. Buyer's premium. 15% for on-site bidders and 20% for online bidders, added to the hammer price.
2. Sales tax. 7% Indiana sales tax is charged on titled vehicles.
3. Payment. Visa, Mastercard and Discover (no American Express), or cash in person. A 3% discount applies to cash payment and a 1% discount to payment within 24 hours of invoice; discounts may be combined. Online buyers are charged the card on file or may pay through their Burgess Auctions account or by phone at 765-445-7814.
4. Condition. All items sell as-is, where-is, with no warranty. Descriptions and photos are for identification only. Bidders should inspect items before bidding.
5. Removal. Buyers remove their items at their own risk and expense by the pickup deadline announced on auction day and posted at BidBurgess.com. Items left after the deadline are forfeited without refund. Burgess Auctions does not load, and no fixture or part of the real estate may be removed.
6. Shipping. Shipping of eligible items can be arranged through Shipping Saint, which invoices the buyer separately. Only paid items are released.
7. Title. Title passes at the fall of the hammer; risk of loss passes to the buyer at that time.
Part C — General
1. Auctioneer's discretion. The auctioneer may group, divide or withdraw items, reopen bidding in a dispute, and resolve all disputes. The auctioneer's decision is final.
2. Online bidding. Online bidding is a convenience. Burgess Auctions is not responsible for internet, platform or device failures, missed bids or delays.
3. Liability. Persons attending the auction or showings do so at their own risk. Children must be supervised.
4. Governing law. These terms are governed by Indiana law. Venue is Marion County, Indiana.
