Broadway Hardware Store — Inventory Liquidation Auction

1. Auction Overview
Burgess Auctions, LLC has been retained to conduct a liquidation auction of the remaining inventory of Broadway Hardware Store, located in Fortville, Indiana, a store that has been closed for approximately eight (8) years. The sale consists primarily of remaining store inventory, with limited equipment and fixtures offered. The auction will be conducted as a simulcast sale — live, on-site, and online in real time — beginning promptly at 10:00 AM on Friday, August 21, 2026. By registering to bid and/or placing a bid, whether in person or online, all bidders agree to be bound by the following Terms and Conditions of Sale.
2. Registration and Bidder Requirements
- On-site bidders must register in person prior to the start of the auction and provide a valid, government-issued photo ID.
- Online bidders must register in advance through the designated simulcast bidding platform and agree to that platform's registration terms in addition to these Terms and Conditions.
- Each registered bidder will be assigned a bidder number, which must be visibly displayed (in person) or is tied to their account (online) when bidding.
- Bidders under 18 years of age must be accompanied by a parent or legal guardian and may not bid in their own name.
- Burgess Auctions, LLC reserves the right to refuse registration or bidding privileges to any individual at its sole discretion.
- A valid SMS consent date will be recorded at registration for bidders who elect to receive text updates.
3. Method of Sale — Simulcast (Live & Online)
This auction will be conducted as a simulcast sale, with bidding accepted simultaneously from bidders on-site and bidders participating live online through the designated bidding platform. Lots are sold in the order determined by the auctioneer to the highest bidder, whether bidding in person or online, as determined by the auctioneer. The auctioneer reserves the right to:
- Group, regroup, or break out lots as necessary for the orderly conduct of the sale.
- Reject any bid that is not a proper advance over the previous bid, or set the bidding increment at their discretion.
- Withdraw any item from sale before the gavel falls, and to re-offer any item in the event of a dispute among bidders.
- Resolve any bidding dispute—including disputes between an on-site bid and an online bid—and the auctioneer's decision on all such matters is final.
Burgess Auctions, LLC is not responsible for any missed bids, internet outages, software malfunctions, or other technical failures affecting online bidders. In the event of a technical failure, the auctioneer may, at their sole discretion, re-offer the affected lot.
4. Buyer's Premium and Sales Tax
A buyer's premium of 15% will be added to the final hammer price of each lot to determine the total purchase price. Indiana sales tax of 7% will be applied to the total purchase price (hammer price plus buyer's premium) unless a valid Indiana Sales Tax Exemption Certificate is presented at the time of checkout.
Accepted forms of payment are:
- Cash
- Valid check with proper identification (subject to approval)
- Debit or major credit card (a convenience fee may apply)
On-site buyers are required to pay in full on the day of the auction, immediately following the close of bidding. Online buyers will be invoiced through the bidding platform and must remit payment in full within the timeframe stated on the invoice. No items will be released, and no items may be picked up, until payment has cleared in full and the auction has concluded. See Section 8, Removal of Purchases, for the scheduled pickup date and time.
5. Condition of Items — Sold As-Is
ALL ITEMS SELL IN AS-IS CONDITION, with all faults, and without any warranty or guarantee of any kind, whether expressed or implied, including but not limited to any warranty of merchantability, fitness for a particular purpose, condition, quantity, or working order. Descriptions provided by Burgess Auctions, LLC, its representatives, or advertising materials—including online catalog listings and photographs—are believed accurate but are not guaranteed. Online bidders acknowledge that photographs and descriptions are not a substitute for in-person inspection. Bidders are strongly encouraged to inspect all items prior to bidding, as all sales are final.
6. Inspection
Preview and inspection of items will be available on-site prior to the start of the auction, and at any additional preview times announced by Burgess Auctions, LLC. It is the bidder's sole responsibility to inspect items in person, or to rely on online photographs and descriptions at their own risk, and to bid based on their own judgment of condition, quantity, and value. No claims, refunds, or adjustments will be considered after the close of bidding.
7. Items Not Included in the Sale
This is a liquidation of remaining store inventory. Nothing attached to the building is included in this sale. Specifically excluded from the auction are:
- Gondola shelving
- Pegboard (wall-mounted)
- Any other fixtures, shelving, or equipment attached to or built into the building
Pegboard hooks located within a bidder's purchased lot section will sell as part of that lot. The auctioneer will identify from the block which items are included with a given lot; any such announcement takes precedence over general assumptions about what is or is not included.
8. Removal of Purchases
Local pickup will be held Monday, August 24, 2026, from 9:00 AM to 3:00 PM. Buyers are required to properly remove all of their purchases in their entirety during this window. Nothing may be removed from the premises until the buyer's invoice has been paid in full and the auction has concluded. Buyers are responsible for providing their own labor, boxes, tools, and equipment necessary for the safe removal of purchased items, including proper packing, loading, and transportation. Removal must be done carefully and without damage to the building, fixtures not included in the sale (including gondola shelving and pegboard), or remaining store property.
- No early removal will be permitted, regardless of payment status, until the auction has concluded.
- Any item not removed by the close of the Monday, August 24 pickup window may be considered abandoned and forfeited without refund, at the sole discretion of Burgess Auctions, LLC.
- Buyers are responsible for any damage caused to the premises, or to fixtures not included in the sale, during removal.
- Burgess Auctions, LLC and the seller are not responsible for loss or damage to purchased items left on the premises after the sale.
- Online buyers are responsible for arranging their own pickup during the stated removal window; Burgess Auctions, LLC does not provide shipping for this sale unless separately announced.
9. Risk of Loss and Liability
Risk of loss for each item passes to the buyer at the fall of the auctioneer's hammer. Burgess Auctions, LLC, its employees, agents, and the seller shall not be liable for any accident, injury, or loss occurring on the premises before, during, or after the auction. Bidders and attendees assume all risk associated with their presence on the auction premises and agree to hold Burgess Auctions, LLC and the seller harmless from any claims arising therefrom.
10. Hazardous and Regulated Items
In the event any chemicals, aerosols, propane, or other regulated or hazardous inventory items are offered as part of this sale, such items will be sold in strict compliance with all applicable federal, state, and local laws. Any additional terms specific to such items will be announced by the auctioneer prior to their sale.
11. Announcements
Any announcements made by the auctioneer from the auction block or through the online bidding platform on the day of the sale take precedence over any previously printed or advertised material, including this document, and will be considered part of the Terms and Conditions of Sale.
12. Agency
Burgess Auctions, LLC is acting solely as an agent for the seller in this transaction. Burgess Auctions, LLC assumes no personal liability for the acts of the seller, nor for the condition, quality, or fitness of any item offered for sale.
13. Acceptance of Terms
Registration to bid, or the placing of any bid at this auction, constitutes full acceptance of these Terms and Conditions of Sale by the bidder.
