GENERAL TERMS
1. All federal, state, and local firearms laws and regulations will be observed.
2. All bidders must be legally eligible to purchase firearms under applicable federal, state, and local laws.
3. Valid government-issued photo ID required for registration and pickup.
4. Federal Firearms License (FFL) holders must provide current copy of license prior to bidding.
ONLINE BIDDER REGISTRATION
1. All bidders must register online and receive a bidder number prior to bidding.
2. Only the Registered Bidder may transfer and take ownership of firearms.
3. You must be 18 years of age to bid on and buy long guns and must be 21 years of age to bid on and buy handguns.
4. Online registration requires:
o Valid government-issued photo ID (uploaded during registration)
o Current phone number and address
o Credit card on file for payment processing
o Signed digital agreement to these terms and conditions
5. Burgess Auctions reserves the right to refuse registration to any person.
PAYMENT TERMS
1. Payment in full required within 24 hours of auction close.
2. Accepted payment methods:
o Credit Card (3% processing fee)
o Debit Card
o Wire Transfer
o Certified Funds
3. Personal checks accepted ONLY from known customers with prior approval.
4. A buyer's premium of 15% will be added to all successful bids.
5. All applicable taxes will be collected.
6. Failure to complete payment within 24 hours will result in sale cancellation and forfeiture of bidding privileges.
FIREARMS TRANSFER AND PICKUP
PICKUP LOCATION: All firearms must be picked up at Fields USA. Contact information and hours will be provided to winning bidders.
1. ONLY THE WINNING BIDDER may transfer or take possession of firearms won at auction. NO EXCEPTIONS.
2. ALL transfers and background checks will be conducted by Fields USA as the receiving FFL dealer.
3. Firearms transfers cannot be redirected to other parties or locations.
4. Fields USA will conduct all required background checks according to federal and state law.
5. Background checks will ONLY be conducted after payment in full is received by Burgess Auctions.
6. The winning bidder must:
o Complete payment in full to Burgess Auctions
o Complete ATF Form 4473 in person at Fields USA
o Pass required background checks administered by Fields USA
o Show same ID used for online registration
o Comply with all waiting periods
o Pay any transfer fees charged by Fields USA
7. For FFL Dealers who are winning bidders:
o Must provide current copy of FFL for transfers
o Must complete transfer in person at Fields USA
o Standard FFL-to-FFL transfer procedures apply
FAILED TRANSFERS AND FORFEITURE
1. If winning bidder cannot take possession for ANY reason:
o No refunds will be issued
o Payment is forfeited
o Firearm will be automatically consigned to next auction
o Original buyer is responsible for:
15% Commission
$5.00 Lot Fee
$30.00 Restocking Fee
2. Any attempt to transfer firearms to someone other than the winning bidder will result in:
o Immediate cancellation of sale
o Forfeiture of payment
o Ban from future auctions
INSPECTION AND WARRANTY
1. All items are sold "AS IS, WHERE IS" with no warranties expressed or implied.
2. Detailed photos and descriptions are provided online for bidder evaluation.
3. All sales are final - no returns or refunds.
4. Descriptions are provided as a courtesy only and do not constitute a warranty.

SHIPPING
SHIPPING OF FIREARMS: All firearms must be shipped to an FFL (Federal Firearms Licensee) of the buyer's choosing. FFLs are fairly easy to find (most gun shops will provide this service), and most charge a nominal fee. A shipping and handling fee will be assessed to the buyer. The receiving FFL will then perform the transfer of the firearm to the buyer including any required background checks. The buyer is responsible for any fees assessed by their chosen FFL.
1. No direct firearm shipping to buyers.
2. All firearms must be shipped to a licensed FFL dealer chosen by the buyer.
3. Shipping costs and arrangements are buyer's responsibility.
4. Insurance and adult signature required on all shipments.
5. Buyer must arrange for their FFL to send a copy of their license to [email protected] with the buyer's name included.
LIABILITY
1. Bidders assume all risks of injury or loss during the auction process.
2. Burgess Auctions and Fields USA are not responsible for accidents or losses.
3. Bidders agree to indemnify and hold harmless Burgess Auctions and Fields USA from any claims.
ONLINE AUCTION CONDUCT
1. The auctioneer reserves the right to:
o Reject any bid
o Resolve bidding disputes
o Withdraw any item
o Group or divide lots
o Extend bidding time if technical issues occur
2. The auctioneer's decision is final in all matters.
3. Bidders are responsible for ensuring their internet connection is stable.
4. Technical difficulties do not void successful bids or extend bidding deadlines.

PROBLEM RESOLUTION
